Wsec.ai is operated by Property Matters LLC, a Washington limited liability company ("Wsec.ai," "we," "us," "our"). These Terms govern your use of the Service.
1. Acceptance
By using Wsec.ai (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Wsec.ai provides AI-powered compliance tools, interactive wizards, calculators, a chatbot trained on the Washington State Residential Energy Code (WSEC-R), and optional human-in-the-loop services (phone consultations and human plan review) to assist with Washington State Energy Code compliance.
It is a software and advisory support tool only — it does not include licensed engineering, architectural, or legal services.
The Service is currently in beta. Features may change, be added, or be removed as we improve the platform. You acknowledge that calculations, AI outputs, and software behavior may be refined over time.
3. No Professional Advice — "AS IS"
All outputs (AI-generated or human-assisted) are provided "AS IS" with no warranties of any kind. We do not guarantee acceptance by any Authority Having Jurisdiction (AHJ). Final code compliance is always your responsibility and that of the licensed professionals you retain.
Wsec.ai and its human reviewers do not practice professional engineering (RCW 18.43) or architecture (RCW 18.08) and do not provide stamped or certified professional services. Any required professional seals, certifications, or stamped drawings for your permit must come from a separately retained licensed professional.
4. Your Content and Our Rights
By submitting content (plans, wizard inputs, chatbot messages, etc.), you grant Property Matters LLC a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, store, analyze, and create derivative works from it for the purpose of operating, improving, and training the Service (including its human review components).
We may de-identify and aggregate your data, and we own that aggregated data outright. We will not sell, license, or distribute your identifiable individual plans, projects, or wizard inputs to third parties. The boundary is identifiability — anything that could be traced back to you or your specific project will not be commercialized to outside parties; anonymized aggregate data may be.
You represent and warrant that you own or have obtained all necessary rights, permissions, licenses, and authorizations to submit your Content and to grant the license described above. You acknowledge that architectural and engineering drawings may be protected by copyright held by the licensed designer or firm that produced them, and that you are responsible for confirming you have authority to upload such content. You agree to indemnify Wsec.ai against any third-party claims arising from your submission of content you did not have the right to submit.
You acknowledge that you have no expectation of privacy in any content submitted to the Service.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose;
- Submit content you do not have the right to submit;
- Attempt to gain unauthorized access to the Service, other user accounts, or our infrastructure;
- Interfere with or disrupt the Service, including via excessive automated requests, scraping, or denial-of-service attempts;
- Reverse engineer, decompile, or otherwise attempt to extract source code from the Service;
- Misrepresent your identity, affiliation, or the information you submit; or
- Use the Service to harass, harm, or impersonate others.
We reserve the right to suspend or terminate access for violation of this Section.
6. Limitation of Liability
To the maximum extent permitted by law, our total liability to you will not exceed the greater of $100 or the fees you paid us in the 12 months before the claim. We are not liable for any indirect, consequential, or punitive damages, including permit delays, redesign costs, or lost profits.
7. Indemnification
You agree to indemnify and hold us harmless from any claims arising from your use of the Service, your submission of inaccurate information, or your submission of content you did not have the right to submit.
8. Payment and Refunds
Pricing for each project or service is shown on the Site at the time of purchase. Payment is collected by our third-party payment processor at the time of purchase. Wsec.ai does not currently offer recurring subscriptions; if subscription products are added in the future, those terms will be presented and accepted separately at that time. Refund decisions are made at our sole discretion on a case-by-case basis.
9. Modifications to These Terms
We may update these Terms from time to time. The version of these Terms in effect at the time of your purchase governs that transaction. Continued use of the Service after an update constitutes acceptance of the updated Terms for any future purchases.
10. DMCA Designated Agent
Property Matters LLC has registered a Designated Agent with the United States Copyright Office under the Digital Millennium Copyright Act. Our agent's contact information is available in the USCO DMCA Designated Agent Directory under Property Matters LLC. You may also send DMCA notices complying with 17 U.S.C. § 512(c)(3) to support@wsec.ai. We will respond to valid notices in accordance with the DMCA.
11. Governing Law & Dispute Resolution
These Terms are governed by Washington law. Any dispute will first attempt resolution through mediation in Spokane County, Washington. If mediation fails, the dispute will be resolved exclusively in the state or federal courts located in Spokane County, Washington.
